Navigating the Regulatory & Enforcement Landscape

E&W was retained by a utility to assess its environmental compliance program and provide strategic counseling related to a series of enforcement actions involving alleged drinking water and wastewater violations.

After an internal investigation and comprehensive assessment of the client’s compliance program, E&W developed and implemented a strategy that successfully resolved the environmental allegations and also revamped the company’s environmental compliance and EHS training program.

The E&W team helped implement the new program through oversight of external audits, training of company personnel and engagement with the company’s senior executives on how to integrate environmental compliance across business units, thus mitigating compliance risks and setting the stage for ongoing success.

Internal Investigations

Assessing Conduct & Executing an Effective Response
Working for a client in the energy sector, E&W oversaw an internal investigation involving allegations of environmental misconduct raised by a whistle-blower who had referred the information for a federal criminal investigation. E&W evaluated the matter, conducted a series of internal interviews, reviewed relevant statutes and policies and ultimately determined the allegations were unsupported.
The E&W team then developed and executed a strategy to engage with federal officials and worked directly with company personnel to prepare for and understand the consequences of such a government investigation. The government ultimately concluded its investigation without any adverse action.
